Please clarify the definition of "agent" specified in the UNOPS General Conditions of Contract. - “Agent” is someone who has the authority to affect the legal relations of another person (the “Principal”) by or with respect to a contract with a third party, whether the agent acts in its own name or in that of the principal. In other words, from our standpoint and in line with the GCCs, as the Contractor is defined to be an Independent Contractor and there is no authority for the Contractor to enter into any legal contract with a third party on our behalf. They do so on their own in order to satisfy their obligations under our agreement with them. This ensures that no Contractor who is in a legal agreement with UNOPS is going to third parties and stating that they are our “Agent” and that they have legal authority to bind UNOPS to obligations.1b. Does UNOPS have any agent for this project? If yes, could you please share the name of the agent and their roles/involvement in the tender/project? Will all UNOPS tenders/projects have the same agent or can it be different for different projects? - No, we do not have any specific agent.2. If we are going to bid in association with other firms in the global network, do we still need to submit Form A? Or can we use other forms of document, e.g., a Letter of Association instead?- Yes, please submit Form A for all parties of the Joint Venture/ Consortium/ Association. New clarification added: Dear bidder,Please see our clarifications below:We would appreciate understanding the sectors to be focussed on as a part of the study. As per the information provided under the requirements of the offeror's qualifications, capacity, and expertise, the target sectors mentioned are buildings, appliances, industry, and transport. Please confirm whether these are the target sectors.Deliverable 6 requires the drafting of the regulation on energy efficiency. We understand that the consultant's role would be to provide and draft technical information for the regulation. However, the legal drafting, lawmaking, and passing of the legislation/regulation are outside the consultant's scope of work. Please confirm.- These two questions are not relevant to the current project. It pertains to the "Strengthening Implementation of Government Regulation on Energy Conservation" project.3. Since CBAM has been introduced only recently (2023 onwards), it may be clarified what is meant by ‘similar projects’or ‘similar services’ in points 1 and 2 of Qualification Criteria.- Please review and comprehend the context of the TOR, especially focusing on the deliverables. The term "similar project" does not necessarily imply a requirement for experience specifically in CBAM. Rather, it indicates experience in conducting impact assessments of policies that could influence the economy and sectoral decarbonization.4. In Technical Criteria section 1: Offeror’s qualification, capacity and expertise, Point 1.1 (1), it may be clarified what is meant by ‘comparable size’. A range of project size may please be provided.- The term "comparable size" pertains to the scope of the project as outlined in the ToR, specifically within the deliverables section. This encompasses factors such as the depth of analysis and the overall scope of the project.5. In Section VIII Qualification and experience of the service provider and evaluation criteria, it is mentioned that “Additional positions such as Carbon Expert, Legal Expert and Gender Equality and Social Inclusion Specialist may be proposed to effectively implement and execute the work plan. The scoring will be considered in Section 2, as part of the implementation of the workplan and methodology”. It may please be clarified how the scoring for additional experts will be done. Also, it may be clarified whether the cost of additional experts will need to be provided in the financial proposal.- 1. No specific scores are allocated for additional experts, however, it depends on the approach and methodology of the bidders if the additional expert is required and adds value to the quality of work to be provided. UNOPS will review and provide the scores based on the points allocated for each criterion and better scores will be given if UNOPS finds that the approach of adding an expert has a positive impact to be performing the works under section 2. The bidder is required to state clearly which additional expert will be served for which criteria under section 2 for ease of our evaluation.2. Costing of additional experts: all costs related to the resources to support the implementation of works as per scopes in the ToR should be presented in the financial proposal.6. It may be clarified if the local firm in Indonesia can be a sub-contractor of the lead firm. The Evaluation criteria use the word JV. It may be clarified if JV can be interpreted as a ‘consortium’ for this RfP.- The bidder may associate with a local indonesia in a form consortium, hower, this would not prevail the main responsibility of the lead consuting firm against the agreement with UNOPS in case of contract award.Best regards,

New clarification added: Dear bidder,Please see our clarifications below:1. In a case where the team leader is an international expert working with a team of national experts, is she/he expected to attend all workshops in person? - No, it's not necessary, as long as there is a representative of the consultant present in Indonesia to attend the workshop.2. If righteously justified within the methodology, is it possible to propose less in-person workshops, or are these a mandatory indication for the client?- This requirement comes directly from the beneficiary. However, if at any point during the project implementation, the beneficiary requests a reduction in in-person meetings, we will adhere to their directive. It's important to note that since the in-person workshop is included in the lump-sum payment as part of the deliverables, any reduction in the workshop will result in a proportional reduction in payment, as outlined in the bidder's financial proposal on meeting packages.3. In the case of an agreement with another company that is different than a JV, shall the other company also show its financial statements and certificates of incorporation? - Certificate of incorporation should be presented for all members as it proves the legal status of the company. On the requirement of financial statement, if you as the leading consulting firm have sufficient financial capacity to meet our requirement as stated in the evaluation criteria, those would not required.Please refer to our qualification criteria for your reference "Financial Capacity/financial stability: Bidder should have a minimum annual turnover of 350,000 USD in any of the past 2 years. In the case of a joint venture, the annual turnover is calculated based on the total annual turnover of the JV members".4. Is the Results-Based Monitoring Framework to be included within the Technical Proposal? In which section should it be included? - No, the RBMF should not be included in the technical proposal.Best regards,

New clarification added: Dear bidder,Please see our clarifications below:1) Regarding the budget for the project: Do you have a specific range of fees in mind for this project? Given the extensive nature of the work outlined, we anticipate needing to involve additional personnel beyond the lead and the five specialists mentioned in the RFP. Secondly, there is a need for extensive stakeholder engagement stated in the RFP. Hence, we would like to understand the the budget allocated for this RFP. - UNOPS cannot share information on budget for any of its tenders.2) We have noted the involvement of multiple government ministries/stakeholders, including Energy Transition Partnership, the Ministry of Trade, the Ministry of Industry, the Ministry of Finance, the Coordinating Ministry of Economic Affairs (CMEA), the Ministry of Energy and Mineral Resources (MEMR), and BAPPENAS. Could you please clarify which stakeholder or entity will be a. contracting party for the RFP - UNOPS will be the contracting party.b. working with the selected consultant to review and sign off on outputs/deliverables- UNOPS will review and provide sign-off on the deliverables further to consultations with the relevant ministries. Please carefully review the ToR. It specifies that the only ministers mentioned in Component 1 and Component 2 are the Ministry of Trade and the Ministry of Industry, and the sign-off will be obtained from these two ministers, as indicated in paragraph 37 (a) on page 19. The key beneficiaries listed in Table 4 represent the list of ministers who could benefit from this project. The consultant's responsibility is to invite these stakeholders to any consultation workshops or events conducted as part of the project. Regarding JETP, their requirement is solely the outcome of the study. Lastly, ETP is a UNOPS program and functions as the project manager, not a government entity.Best regards,

However, given the upcoming Lebaran/Eid holidays, and that offices in Indonesia close in the middle of this week and only reopen 2 weeks later (~ 16/4/2024), can we request a further extension to early May 2024?- Given the significance of this project and the stringent timeline set by the government, we are unable to extend the deadline beyond April 26th.Best regards,

In any case, can the bidder's conference be recorded and supplied to all interested bidders?- The pre-bid meeting cannot postpone the date. However, the minutes of the pre-bid meeting will be shared through e-sourcing.
