QUALIFICATION CRITERIA, item number 3 "The bidder shall be a registered organization under relevant government regulations to provide services in Somalia", we have one question: if we are going into a JV, does the lead company need to have all those registration certificates in Somalia or Incorporation Certificate from country of origin would be enough? Or just with one of the JV members having them would be enough?RESPONSEThis is an international bid, so incorporation certificates from the country of origin would be enough.Thank You,

New clarification added: QUESTIONSDear Sir/Madam,I would like to seek te following clarifications:Q1: Section 1, Instruction to offer, page 3 of 33 on the qualification criteria under item 2. financial capability ''The offeror has an annual turnover of minimum 1,000,000 USD in any one of the last five years''. Does this apply to all members of the JV or can alternately be considered incase one member of the JV doesnt meet thi requirement? Does this requirment also apply to sub consultants?Q2: Section 1, Instruction to offer, page 4 of 33 on the qualification criteria under item 5. "The offeror has the registration under the category/grade in the body that governs and regulates the engineering, consulting and /or construciton industry in the country". Does registration in Kenya apply?Q3: In the terms of reference (Page 44), the document lists a senior sewer and hydraulic Engineer. Is it acceptable to submit two separate CVs for this position considering that the two specialities are usually separate and if so then how will the scores on page 9 of 33 (ITO) be distriuted? In case of sub-consultant, it is not required at this stage, however, cross check might be done at a later stage, and sufficient information shall be provided to allow us verifying the financial and technical capacity of the subconsultant. Noting that any subconsultant shall be reviewed and approved by UNOPS.Thank You,

New clarification added: QUESTION 10.Section 9.2 on the Proposed Project Team One of the scope of works described in the TOR include Identification and Prioritization of Investment Options for Urban Flood Resilience.Section 9.2 on the Proposed Project Team do not provide for an economic feasibility expertKindly clarify whether include Identification and Prioritization of Investment Options for Urban Flood Resilience will or will not include economic feasibility considering that there is no input of an economist in the key personnel required for the assignment.RESPONSE 10.The feasibility study is part of the scope of work, it is the tenderer's call to do this study by his economic feasibility expert, or to outsource it to a subconsultant.In case the tenderer chose to utilize his expert, expert C.V shall be submitted for review and approval.

From the understanding of the assignment as per the ToR, the major component of the project is stormwater drainage management and not sewerage works Kindy clarify on whether the firm requirement for experience in sewerage works can be substituted with experience in hydraulic and stormwater drainage designs.RESPONSE 1Confirmed. Hydraulic and stormwater experience is accepted.Question 2Terms of Reference: Section 9.2 Proposed Project Team The ToR requires a Senior Sewer and Hydraulics Engineer:As above Kindly clarify whether the Senior Sewer and Hydraulics Engineer can be replaced with Senior Drainage & Hydraulics EngineerRESPONSE 2Confirmed.Question 3Section II: Evaluation Method and Criteria: Section 1 Formal and Eligibility Criteria The bid requires all bidders to fill returnable schedules and upload them in the system Kindly clarify if all members of the JV are required to complete and return the returnable schedules and questionnaires or the lead JV member can complete and submit these on behalf of the JV members. To also confirm if these can be downloaded, completed and uploaded as part of the bid submission.RESPONSE 3The submission shall include all the eligibility requirements for JV partners, as illustrated in Article 4 “OFFEROR ELIGIBILITY” of InstructionstoOfferors, and also as per the eligibility requirement in the evaluation criteria.QUESTION 4Terms of Reference: Section 2 Objectives of the Services Item No. 2. Skill Transfer/Capacity Building of the PIU and Ministry of Public Works contracted staff The ToR describes that: Capacity building activities will be included in the project for a cumulative 12 months for a tentative 18 staff (respectively from the Municipality and Municipalitiesserved by SURP II/Nagaad, as well as from the Federal Government of Somalia and the Federal Member States Ministry of Public Works). Kindly clarify if the costs for the 18No. staff proposed to be seconded to the project during implementation for the purpose of capacity building through on job training will be borne directly by UNOPS.RESPONSE 4All costs related to capacity building will be covered by UNOPS.Question 5Terms of Reference Section 4.4 Cost of Payment of Consultant’s Services The ToR describes that: Payments to the Consultant shall be made on the basis of one final invoice submitted by the Consultant to UNOPS in accordance with actual progress of the Consultancy works as certified by UNOPS. Kindly clarify if this one final invoice refers to the milestone payments that are to be done upon submission and approval of specified deliverables as per section 4 of the TORRESPONSE 5The payment will be based on approved deliverable bases, as shown in the list of deliverables, the distribution % of payment along the deliverables milestones will be finalized during the awarding stage.Question 6Section II: Evaluation Method and Criteria: Section 2. However, it is advantageous if this is submitted for the other JV partners.Question 7Terms of Reference: Section 3.3The ToR describes that: The consultant shall Provide UNOPS with its representative entity based centrally in Somalia for the entire duration of the services to ensure appropriate and efficient coordination with UNOPS and project stakeholders. Kindly clarify whether the representatives include the specific personnel like the Design Manager?RESPONSE 7The consultant shall maintain the minimum required representative in Somalia for daily and weekly communication with stakeholders, UNOPS and client, the design team is not necessarily to be on Somalia, but design team shall conduct a minimum no. of site visit to familiarize them self with site conditions and requirement, and design team is required to attend a weekly virtual meetings, and addition to any requested meetings by UNOPS or Client.QUESTION 8Terms of Reference Section 3.5: Gender and Sustainability The ToR describes that the consultant will have to demonstrate how their activities take gender and diversity into account during all phases of the design and apply it to its staff and operations as part of the proposal. Gender and diversity should be considered internally during project design staffing processes. Kindly clarify on whether there is any criterion for gender e.g. proportion of male to female in staffing of the proposed personnel at the bidding stageRESPONSE 8There is no specific criteria, but we would like to see a tenderer proposal for gender and diversity plan during the implementation of the project. QUESTION 9Terms of Reference: Section 3.6 Scope of Works and Section 9.2 Proposed Project Team One of the scope of works described in the TOR include Identification and Prioritization of Investment Options for Urban Flood Resilience.RESPONSE 9It is Part of scope of work is to conduct a feasibility study, this study shall be done by analyzing and assessing the urban flood risks and the existing stormwater drainage system, flood and risk maps were elaborated, identifying areas most at risk (“hotspots”), Then, prioritization of the interventions shall be defined to create investment packages, identifying intervention clusters that can be implemented independently and provide at least a partial grade of functionality for stormwater drainage is critical. furthermore, the common practice for such scope is to divide the city into a number of catchment areas, and then prioritize these catchments.

New clarification added: Is it a mandatory requirement for each member of a Joint Venture, Consortium, Association and/or Sub-consultant to be an UNGM registered vendor or a UNOPS vendor to be eligible to bid for this assignment.it is mandatory for the lead member of the Joint Venture, however, we will do a background check on all joint venture members, and subconsultant to ensure non of them is banned or blacklisted from participation under any procurment proccess under UNGM. so tenderor is requested to ensure non of his joint venture member or subconsultant is banned on UNGM.

New clarification added: Dear Tenderor, Please note that under eligibility criteria we look at the UNGM list to ensure the vendor is not banned or black listed from participation under any procurement process under UNGM. Furthermore, as illustrated in Section I, Article 32,33,34. The vendor will be required to complete the vendor registration process on the UNGM prior to the signature and finalization of the contract. so it is not a requirement to be registered under UNGM at this stage.
